COMPROMISO ÉTICO CONTRA LA IMPUNIDAD

Abstract

Abstract. Impunity for crimes that constitute crimes of lesa humanity, as the torture, the forced disappearance of people and the summary or extrajudicial executions, extends the legal thing merely. This leads to other fields, among them the one of the ethics, before an essential characteristic of these crimes: that they harm the intrinsic dignity of the human being. By the same reason, through specific conventions for each of these crimes, the international community has excluded the possibility from any argument that justifies or relativizes its absolute prohibition. At the same time, it demands an integral repair on the part of the State for the surviving victims and the relatives of victims.

Resumen. La impunidad para delitos que constituyen crímenes de lesa humanidad, como la tortura, la desaparición forzada de personas y las ejecuciones sumarias o extrajudiciales, trasciende lo meramente jurídico. Esto conduce a otros campos, entre ellos el de la ética, ante una característica esencial de estos crímenes: que vulneran la dignidad intrínseca del ser humano.

Por el mismo motivo, a través de convenciones específicas para cada uno de estos delitos, la comunidad internacional ha excluido la posibilidad de cualquier argumento que justifique o relativice su prohibición absoluta. Al mismo tiempo, exige una reparación integral por parte del Estado para las víctimas sobrevivientes y los familiares de víctimas.
