Como efecto de la globalización de las relaciones económicas y sociales, el contenido actual del concepto de ciudadanía se diluye en lo referente a los derechos políticos como a los derechos sociales, porque la responsabilidad por la garantía de estos, que hasta ahora ha sido pensada como adscrita al Estado nacional, se evapora en las efímeras e irresponsables relaciones de un mercado sin sitio ni ley. Luigi Ferrajoli propone evitar este peligro sin renuncia a la globalización mediante un constitucionalismo regido y universal con capacidad de coerción.
