Del delito común al delito político en Los ojos del basilisco de Germán Espinosa

Resumen: Este artículo propone un análisis interdisciplinario de Los ojos del basilisco que reúne laLiteratura, la Historia y el Derecho. La novela -inspirada en el ‘caso Russi', ocurrido en la Bogotádel siglo XIX- es la materia prima que el escritor Germán Espinosa utiliza para revisar lahistoriografía existente en torno al nacimiento y la consolidación de los partidos políticos enColombia. Espinosa ofrece una nueva perspectiva jurídica de la pena de muerte por homicidio comodelito político, para revelar así las contradicciones en la época y la ilegitimidad del Estado. Seperciben de este modo los matices que existen entre la novela histórica y una novela de crímenesbasada en el concepto de anomia que utiliza el autor.

Abstract: This article offers an interdisciplinary analysis of Germán Espinosa´s novel, Los ojos delbasilisco, combining literature, history and law. In the novel Espinosa approaches the Russi scandalthat took place in Bogotá in the 19th century and reviews the historiography around the birth andconsolidation of political parties in Colombia. The novelist offers a new juridical perspective on theissue of death penalty by homicide as a political crime, to thus reveal contractions and the illegitimacy of the State. It is also possible to see the nuances between historical and hard-broilednovels within the concept of anonymity used by the novelist.
