Act of correction of misdeeds or as legislated by a formally administrative

The proposed analysis is focused on the study of a particular typology of acts, act of correction of misdeeds in the abstract. Its theoretical support lies in the need to correct the misdeeds that may be incurred by the legislator at the time of issuing laws, to facilitate its effective implementation; so the only purpose of the Act, to ensure the effective implementation of the law, what makes their legal nature of an administrative nature and is subordinate to the law. Both the Council of State and the Constitutional Court jurisprudence seems to give support to this type of act in the Colombian legal system. However, if a judicious analysis on the constitutional and legal rules that support competition to dictate this kind of act he could arrive at the opposite conclusion. Analysis of the Act 1736 of 2012 “correcting” misdeeds to the General code of the process (law 1564 of 2012) shows that the acts of correcting mistakes in the abstract are not based hand are used to bypass constitutional reservations (art 150-2 , 189 -10), and legislate by decree formally administrative matters reserved to the democratic legislature ( law - code ) .
