Historical precedents about idea of the business companies how contract in Colombia

This job tries to show how in Colombia has applied contractual and plurality theory in business companies topic. First of all, by means of a historical recount about the business practices that are precedents to the modern companies; second of all, by means of historical monitoring to the norms of the Commercial Code, Decree 410 of 1971, that regulates the legal nature of the company how a contract. These two elements will allow to base these hypotheses: a. Contractual and plurality theory about companies in Colombia has its origin and support in the groups that, with intention to collect efforts and capitals, they were created in the trade practices previous to the codifications. b. Contractual and plurality theory about companies supports it in the european idea, that is contained in the codes of XIX century that arrive to Colombia with the reception of the positive company law.

Estudios de Derecho is governed by the following regulation: Political Constitution of Colombia, article 61; Law 23 of 1982, articles 1 and 2; Law 44 of 1993, chapter II, article 6 and chapter IV, article 51; Law 599 of 2000 through which the Penal Code is issued, articles 270, 271 and 272.
