Abstract

The institution of the responsibility under the opeation of the Constitution of 1991 has stopped being exc\usive for the administrative function and in the events ofservice failure and it has been extended to al! the branches ofpublic power and to all the State functions, including those who rose to constitutional rank like the control function. The responsibility is preached of all State entities and in all the events where a patrimonial or moral damage is caused and the person is not in the legal obligation of supporting it or that exceeds the balance of public charges between to the State and the citizen, but each function has its particularitities that determined if a antilegal damage has been caused or not.
