Abstract

In this article is realized a history of the discursive and no discursive practices of the medicine and of the law across of some criminals conducts described in the call colombian Penal Code of 1980. Conducts how dishonest abuses, forces and violence, for a side, and aborts and homicides of children, for other side, make visible both the legal discourse and medicine- legal discourse. The study of this file permitted understand that in the judicial decisions moral didn´t be determinant; that the medical expert reports almost always were practiced, but in much occasions were objected because they aren´t scientific and that the decisions, in relation with this crimes, were made accord to the rigorous of the criminal judge, fact that explain, in part, the much of stay of proceedings that are observed in the procedures and that in occasions look arbitrary.
