About the Limits of New Wars. A Review from the New Nomos of the Earth and the Theory of Large Spaces

The rise of new and irregular wars, along with the persistence of terrorism and the expansion of armed conflicts across various continents, has placed increasing strain on the global order that emerged after the Cold War —an order that had suggested a scenario of relative global stability. Within this shifting context, international humanitarian law (IHL) appears to be losing effectiveness, particularly due to the erosion of fundamental principles such as proportionality and the distinction between combatants and civilians. This essay reflects on ways to contain 21st-century warfare through the lens of the theory of large spaces and the balance of power. From these theoretical perspectives, it is argued that an essential principle can be consolidated to limit contemporary modes of warfare. The analysis adopts an interpretative approach in which concepts that are often intertwined in practice serve as starting points for critical reflection. In this context, the essay proposes a reconsideration of the nomos of the Earth, as a framework for organizing and distributing global space, through the concept of large spaces, engaging with the political thought of philosopher Carl Schmitt.
