Abstract

Understanding the factors that influence in the definition that we give to the concept of sexuality, as well as the ways in which it is regulated and protected by the State, is one of the analytic objectives of the debate. As sample of that debate, this essay intends: i) Analyze three important conceptions on the theme of the sexuality that illuminate the debate on the sexual violence: a. That of the rational autonomy, b. That of the sexual autonomy, c. Against the idea of autonomy. ii) Analyze, in each one of those three ideas, which is the role of the Law in the definition of victim and in the structuring of the crime of sexual violence. iii) Analyze two ways of action that have the objective to diminish the incident of the sexual crimes presenting the arguments that support them and the difficulties that face. They are: the acts of speech and the criminal law.
