Abstract

This Article tries to make epistemological precision aboutthe origin offundamental rights. The relation between them and subjective rights, on one side, and patrimonial rights, on the other. Seeking that goal two contexts are established: One of them presents the contribution of juridical philosophy and political philosophy to this concepts. In the other we will appeal to the jurisprudence developed in the sentences of our country's Constitutional Court. All this to conclude that property isn't itself a fundamental right.
