Abstract

In our legal system the postulate of good faith (article 83 of Politic Constitution of Colombia) was uplifted to constitutional rule. That rule establishes a presumption with effects in the process that benefices to the people when act front to the State and it benefices the public server for effects in his personal responsibility. Principle of good faith restores one of the most important aspects of the human: dignity, as well, that complies three operative functions in the law: is the foundation of the legal system, informs the interpretative job and is an instrument of integration. However, in our system haven´t been clear the positions adopt by the organs responsible for the control of the administrative function, like that by the Constitutional Court, with respect to the related with the addresses of the presumption establishes in that. Now, if this text is understood how a General Principle of Law, in the marc of a Social State of Law, in that the values obtain a binding character, between they are the value of the human dignity, is necessary to accept that the rational decisions and reasonable of the public serves, must suppose that are of good faith, just as happen with the actuation of the people.
