The Familiar Mediation in aTransformer Framework

The familiar mediation is a little-know issue in Colombia. May be biggest the leadership that has been received after the inclusion in the Procedural Penal Law how tool of the restorative justice. More scarce is the issue, the transforming mediation proposed by Baruch Bush and Folger like an effective scope in the production of social and personal transformations. This paper brings together the two thematic: shows some general aspects of the mediation, stands what is meant for the concept of transformative mediation, the characteristics, the principles, the procedure, the mediator’s role and the potential of that involves the implementation in the familiar conflict cases. The greatest aspiration of this work is to contribute is the diffusion of this alternative dispute resolution method and the positioning like a formulate of “co-constructive” justice that transcends the private ambit and permits the empowerment, like citizens, the actors in dispute, binged the scopes, deduces by the implementation in the social, politic, cultural location.

Estudios de Derecho is governed by the following regulation: Political Constitution of Colombia, article 61; Law 23 of 1982, articles 1 and 2; Law 44 of 1993, chapter II, article 6 and chapter IV, article 51; Law 599 of 2000 through which the Penal Code is issued, articles 270, 271 and 272.
