Abstract

The DPSRC are legally created bodies, attached to their respective ministry and with essencialIy technical nature. Their main function according to Ley 142 de 1994 (Law # 142 of 1994),is to promote competence between domiciliary public services operators, to prevent abuse of the dominant position and to protect user's rights. This function of the commissions implies the creation of legal regulations about several aspects of domiciliary public services, and in that sense it can be said about a normative function of the comrnissions. But ¿What kind of normative function specifically are we talking about? ¿Are the commissions regulating, almost-legislating or their normative function is new and independent8Regulatíve function)? ¿What are the jurisprudence and doctrine postures about that normative function?
