Abstract

At a time, when there is a strong legal and doctrinal insistence around the fact that the provision of domiciliary public services can´t be assumed as part of the administrative function of the State, as it was already a traditional consideration, this article tries to show, from a research made over the period between 1998-2004 that took as reference of analysis the so called “acciones populares”*** where were discussed the collective right to access and efficient provision of public services, that the jurisprudential reality is very far from accepting this argument and that the classic French inspiration theory for public services, that many believed outdated, is still in valid.
