En los orígenes decimonónicos de la antropología contamos con autores que, sin ser antropólogos de formación, ejercieron como tales y reflexionaron desde la jurisprudencia los asuntos propios de su tiempo. En esta pléyade de figuras se encuentran los nombres de Bachofen, Maine, McLennan y Morgan, quienes, interesados por entender el pasado y el destino de Occidente, se ocuparon de estudiar la evolución de la familia, el matrimonio, la propiedad, la herencia y el parentesco como instituciones sociales. Esta tradición inició con los juristas e historiadores que, haciendo las veces de etnólogos de poltrona, fueron construyendo con el tiempo un campo particular de la antropología, conocido hoy como la antropología jurídica, la cual reconoce a estos hombres como los antecesores de su pensamiento.
