En el marco de la conformación de un Estado de derecho, el articulo intenta ubicar la función y la responsabilidad que compete al juez como elemento central de una nueva concepción del derecho, en la cual la norma es no solo la base fundamental del orden jurídico, sino la garantía de funcionamiento de la concepción política a que debe responder este último.
