Cuando el legislador confía a la justicia del trabajo la declaración sobre ilicitud de una huelfa no pretende con ello conseguir conclusiones teóricas, sino que busca fines prácticos. El propósito centarl que perigue la ley al consagrar el sistema para conseguir la declaración de que una huelga es ilícita, es obtener su terminación pacífica, lo que se desprende principalmente de que tal declaración, no conlleva sanciones inmediatas, sino condicionadas a que los trabajadores no acepten el plazo de gracia qye se les concede para regresar a sus labores dentro de las 24 horas siguientes, pues si esto último ocurre, ninguna sanción se les impone.
