Cultural Aspects of Legal Translation: The Case of Birth Certificates in French and Portuguese

Abstract

The birth certificate is an extremely important document in the life of a subject, as it is the first document of the citizen to have legal value and to be used as proof of age, nationality and filiation, thus guaranteeing certain rights to the citizen. In order to explore the linguistic, cultural and legal implications of such a document, we start from a corpus of Sworn Translation of birth certificates from French from France (ff) to Portuguese from Brazil (pb) and vice versa, in order to analyze the terms and expressions present in this corpus and how they are doing in this movement of translation. We are, therefore, in a field which encompasses distinct perspectives in relation to specialized trans­lation. Thus, our study is based on the research of Crépon and Rodrigues, concerning the theoretical field of Translation Studies, and the work of Gémar, Peron Guedes and Mozzilo and Harvey with regard to the relationship between Translation and the Law. We have verified that the specificities of Brazilian and French law are either explicitly marked or erased, performing a movement that is both “domestication” and “foreignization” in terms of translation. This study is of major importance once it proposes to discuss the cultural and linguistic relations which are intrinsic to translation practices and whose outlines may be more or less identifiable depending on the contexts in which they occur.

Author Biographies

Milena de Paula Molinari, São Paulo State University

Currently, he is developing research at the Doctoral level (2018-2022), with the Postgraduate Program in Linguistic Studies, at Unesp/São José do Rio Preto, under the guidance of Prof. Dr. Maurizio Babini. She held a Doctoral Research Internship at the Université Sorbonne Nouvelle-Paris III, in France, at the laboratory ED 268-Langage et langues: description, théorisation et transmission, with a scholarship from the CAPES / PrInt program, between September 2019 and February 2020, under the guidance of Prof. Dr. Isabelle de Oliveira. She attended the Masters (2014-2016) at the Postgraduate Program in Linguistic Studies, at Unesp / São José do Rio Preto, under the guidance of Profa. Dr. Lidia Almeida Barros, with CAPES funding and received a Master's degree in July 2016. She graduated in Bachelor of Arts with Qualification of Translator (French/Italian) (2013) by the same institution and performed Scientific Initiation under the guidance of Prof. Dr. Lidia Almeida Barros, with FAPESP funding. Since 2014, she has been working as an English and French Language teacher. She has experience in Linguistics, working mainly on the following topics: Terminology, Bilingual Terminology and terminological variation.

Beatriz Curti-Contessoto, University of São Paulo

Currently, he is developing postdoctoral research at the University of São Paulo (USP). She holds a PhD in Linguistic Studies from the Postgraduate Program in Linguistic Studies at Universidade Estadual Paulista (UNESP). During her doctorate, she carried out a research internship at the Université Sorbonne Nouvelle-Paris 3. She is also a Bachelor of Arts with Qualification of Translator (French / Spanish) by UNESP. As a researcher, she works in the field of Linguistics, with an emphasis on Mono / Bilingual Terminology, Diachronic Terminology and Terminological Neology. Her researches mainly address issues of Portuguese-French equivalence, sociocultural and historical aspects that underlie the terms (especially in the legal domain) and sworn translation. As a professor, she worked in extension and undergraduate courses at the two institutions where she developed her research. She also collaborated with the Center for Resources and Information en Français (CRIF), founded by UNESP and the French Consulate of São Paulo, and with the Interdepartmental Center for Translation and Terminology (CITRAT) at USP.

Maria Angélica Deângeli, São Paulo State University

Maria Angélica Deângeli is professor of francês do Departamento de Letras Modernas da Universidade Estadual Paulista “Júlio de Mesquita Filho” (Unesp), capus of São José do Rio Preto (SJRP). Doutora em Letras pela Unesp (SJRP) e mestre em Linguística Aplicada pela University of the Sorbonne Nouvelle (Paris III). Atua no Programa de Pós-Graduação em Estudos Linguístico da Unesp (SJRP) na linha de pesquisa de Estudos da Tradução. É Bacharel em Letras com Habilitação de Tradutor e supervisora ​​de língua francesa da Oficina de Tradução da Unesp (SJRP).
